Start with the task, rather than a visa name alone. An application, a request for information, a refusal and a cancellation require different assessments—even when they concern the same visa.

Depending on the agreed scope, a lawyer can:

  • Assess eligibility and restrictions: identify the relevant criteria, visa conditions and statutory issues before an application is prepared.
  • Organise evidence: connect records to the matters that must be established and identify missing or inconsistent information.
  • Prepare applications and responses: draft submissions and address the specific questions or concerns in Department correspondence.
  • Assess adverse decisions: distinguish a refusal from cancellation and identify any available merits review or revocation process.
  • Prepare for proceedings: organise the decision history, evidence and submissions for a tribunal hearing or assess potential court proceedings.

When does a visa matter need urgent attention?

Prioritise these situations:

  • A notice asks you to respond. Keep every page, attachment and the email or envelope showing receipt. Identify what is requested and the stated response date.
  • A refusal or cancellation has arrived. Preserve the decision and reasons immediately; do not assume another application is available or that review can be lodged later.
  • Your visa is approaching expiry or may have expired. Check the operative grant and any later visa, rather than relying on an application receipt.
  • Court proceedings may be necessary. Obtain an assessment of the decision and procedural history before assuming a court will reconsider the evidence.
  • Detention or an immediate status problem is involved. Tell the lawyer about your location, current documents and any official directions at the outset.

Requests under s 56 and invitations concerning adverse information under s 57 are different procedures. The notice, applicable prescribed period and s 58 requirements must be assessed; there is no single response deadline for all letters under these provisions of the Migration Act.

For ART matters, the Tribunal’s guidance states that it cannot extend migration review application time limits. An enquiry to this guide is not a review application and does not protect a deadline.
