A refusal or cancellation does not automatically carry a right to Administrative Review Tribunal (ART) review. Review eligibility, standing and time limits depend on the decision category and circumstances; the ART cannot extend migration review application time limits. Use the notification letter and ART immigration and citizenship guidance, rather than assuming a standard deadline.

For an expiring or expired visa, have the actual grant and operative dates assessed promptly. Authorised immigration assistance. Perth-based access to immigration assistance is subject to Migration Act s 280 restrictions, with exemptions including Australian legal practice. Do not take professional indemnity insurance cover for an unauthorised Perth helper’s sponsorship mistake for granted, or assume losses arising from it can certainly be recovered.

Which records should be prepared for a consultation?

  • Supporting evidence: records relevant to the matter, such as relationship, employment, study, health or sponsorship documents.
  • Chronology: key application, travel, notice and decision dates, plus any stated deadline.
  • Existing proceedings: review applications, directions, hearing notices, orders and documents already filed.

Judicial review is different from merits review: the Court examines jurisdictional error, not whether it would make a preferable visa decision, and it does not grant visas. The Court’s migration-review guidance states a 35-day filing period and an extension-application route; have the relevant decision and timing assessed rather than applying that period to ART proceedings or every court matter.

Ministerial intervention is another distinct pathway, not a further tribunal appeal. The relevant powers are personal and non-compellable, and the applicable instructions govern eligibility; a request does not compel consideration or maintain lawful status. For appointments arranged across states, confirm the date, time and time zone with the practice or registry. Do not use an appointment conversion to calculate a legal deadline.
